1. Introduction

These Terms of Service ("Terms") govern your access to and use of the services provided by Everstone Property Partners Limited ("Everstone", "we", "us", or "our"), including our website, property lettings management, and all related services. By engaging our services or using our website, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you should not use our services. We recommend that you read these Terms carefully before proceeding.

2. About Us

Everstone Property Partners Limited is a property lettings and management company registered in England and Wales (Company No. 16796046). Our registered office is at St Bedes Chambers, Albert Road, Jarrow, England, NE32 5RR. We are members of the Property Redress Scheme and hold Client Money Protection insurance through MoneyShield.

3. Services

Everstone provides the following services:

  • Lettings Management – marketing rental properties, sourcing and referencing tenants, managing tenancy agreements, rent collection, and ongoing property management.
  • Landlord Services – portfolio management, compliance advice, property maintenance coordination, and financial reporting.
  • Tenant Services – property viewings, tenancy applications, deposit handling, and maintenance request management.

The specific scope of services will be detailed in any management agreement or tenancy agreement entered into between you and Everstone.

4. Client Obligations

By using our services, you agree to:

  • Provide accurate, complete, and up-to-date information as reasonably requested.
  • Comply with all applicable laws and regulations, including but not limited to landlord licensing requirements, gas safety regulations, and electrical safety standards.
  • Maintain appropriate insurance cover for any property managed by Everstone, including landlord buildings insurance and, where applicable, contents insurance.
  • Respond to communications from Everstone in a timely manner, particularly regarding urgent maintenance or compliance matters.
  • Not use our services for any unlawful purpose or in a way that could damage our reputation.

5. Fees & Payment

Our fees and charges will be clearly set out in the management agreement or service agreement entered into between you and Everstone. Unless otherwise agreed in writing:

  • Management fees are deducted from rental income before disbursement to the landlord.
  • Additional charges may apply for services outside the standard management agreement, such as property inspections, court attendance, or major works coordination.
  • All fees are subject to VAT where applicable.
  • Invoices are payable within 14 days of issue unless alternative terms have been agreed.

We reserve the right to adjust our fees with reasonable notice. Any fee changes will be communicated to you in writing at least 30 days before they take effect.

6. Client Money Handling

Everstone holds Client Money Protection (CMP) insurance and is committed to the safe handling of all client funds. All client monies, including rent, deposits, and maintenance funds, are held in designated client accounts separate from our business accounts, in accordance with our obligations under the relevant regulations.

Tenant deposits are protected with a government-approved tenancy deposit scheme as required by the Housing Act 2004.

7. Property Listings & Advertising

All property listings published on our website and third-party portals (including Rightmove and Zoopla) are prepared with reasonable care. However:

  • Listings are provided for general information purposes and do not constitute an offer or contract.
  • While we endeavour to ensure accuracy, we do not guarantee that all information (including dimensions, condition, and available dates) is complete or error-free.
  • Photographs and virtual tours are intended as a general guide and may not reflect the current condition of the property.
  • Availability and pricing are subject to change without notice.

8. Website Use

Use of the Everstone website is subject to the following conditions:

  • The website content is provided for general information only and should not be relied upon as professional advice.
  • We do not guarantee that the website will be available at all times or free from errors or viruses.
  • You must not misuse the website by knowingly introducing viruses, trojans, or other material that is malicious or technologically harmful.
  • All intellectual property rights in the website content, including text, images, logos, and design, are owned by or licensed to Everstone and may not be reproduced without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Everstone shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website.
  • Our total liability in connection with any claim shall not exceed the total fees paid by you to Everstone in the 12 months preceding the claim.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Termination

Either party may terminate the service agreement by providing written notice in accordance with the terms set out in the relevant management agreement. Unless otherwise stated in the agreement:

  • A minimum notice period of two months is required for termination of management services.
  • Outstanding fees and expenses incurred prior to termination remain payable.
  • Upon termination, Everstone will transfer all relevant documentation, keys, and client funds within a reasonable timeframe.

11. Complaints & Dispute Resolution

If you are dissatisfied with any aspect of our services, please contact us in writing at the address below. We will acknowledge your complaint within 3 working days and aim to provide a full response within 15 working days.

If we are unable to resolve your complaint to your satisfaction, you may refer the matter to the Property Redress Scheme, of which Everstone is a member. Details of the scheme are available at www.theprs.co.uk.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

Everstone reserves the right to update or amend these Terms at any time. Any significant changes will be communicated to affected clients in writing. Continued use of our services following any changes constitutes acceptance of the revised Terms.
